Tragic Car Crash Incident: Father Dies, Mother on Trial

In a tragic case, a girl, whose father died in a car crash, claimed he had put them "in danger," as presented in court.

The incident occurred on Saturday, November 6, 2021, when the child, who cannot be named for legal reasons, was traveling in an Audi A8 that crashed into a tree in Bolton. Her father, Thomas Benson, lost his life in the collision, while her mother, Alicia Fairclough, was driving.

Alicia Fairclough is currently on trial at Manchester Crown Court, facing charges of causing death by dangerous driving. She sustained serious injuries during the accident.

Prior to the incident, the family had attended a wedding at Rivington Barn. On November 27, jurors learned that Ms. Fairclough was allegedly driving her partner’s Audi A8 at more than double the 30mph speed limit on Lever Park Avenue in Horwich when the crash occurred.

Following the collision, a motorist named Robert Hayes-Carr, who was driving in the opposite direction, came to assist. The girl reportedly asked him, “Why did my daddy do that?”

During a recorded video interview played to jurors, when asked why she made that statement, the girl responded, “Because at the end of the day, he basically put us all in danger.”

The prosecution, led by Joe Boyd, questioned the child about the day of the incident. She recounted, “My dad started saying ‘you drive, I’m drunk’. After a minute or so they started arguing.”

She recalled her father unbuckling his seatbelt while they were driving, and when asked about the car's speed, she said, “I think she changed it after he took his seatbelt off.”

When asked to elaborate, she expressed uncertainty but continued, “My dad pulled the wheel, he kind of like grabbed it.” She described feeling the car skidding as her mother tried to maintain control. “He started trying to tug it and then he pulled it like really hard,” she added.

Regarding her mother’s condition post-accident, she mentioned, “She couldn’t remember much because she hurt her head. She had a brain bleed after.” Alicia Fairclough, of Fairways, Horwich, has pleaded not guilty to the charges against her.
